Formål og retsgrundlag for behandlingen personoplysninger

Herning Kommune behandler de indsendte personoplysninger til følgende formål:

• For at kunne behandle din henvendelse.
• For at kunne opnå en effektiv behandling af henvendelser og holde styr på, hvilke henvendelser der er behandlet, herunder til brug for fremsøgning af tidligere praksis.

Retsgrundlag for Herning Kommunes behandling af dine personoplysninger:

• Databeskyttelsesforordningens artikel 6, stykke 1, litra c og e.
• Databeskyttelsesforordningens artikel 9, stykke 2, litra f.
• Databeskyttelseslovens § 8, stykke 1, 2 og 3.
• Databeskyttelseslovens § 11, stykke 1.

Tidsrum for opbevaring af personoplysninger

Herning Kommune arkiverer og sletter de indsendte oplysninger, jævnfør de gældende regler for kassation, som er aktuelle for den sag, din henvendelse drejer sig om.

Dine rettigheder

Databeskyttelsesforordningen opstiller en række rettigheder du har, når Herning Kommune behandler personoplysninger om dig. Hvis du vil gøre brug af dine rettigheder, skal du kontakte Herning Kommune.

• Ret til oplysning – du har ret til, uden unødig forsinkelse, at blive informeret om vores indsamling og behandling af dine personoplysninger (senest en måned efter indsamlingen).
• Ret til indsigt – du har ret til at blive gjort bekendt med personoplysningerne, vi behandler om dig, og desuden til en række oplysninger derudover.
• Ret til berigtigelse – du har ret til at få urigtige/forkerte personoplysninger om dig rettet.
• Ret til sletning – du har ret til at få personoplysninger om dig slettet, såfremt vi ikke er underlagt anden lov til opbevaringen.
• Ret til begrænsning af behandling – du har ret til at få begrænset behandlingen af dine personoplysninger, hvis bestemte kriterier er opfyldte.
• Ret til dataportabilitet – du har i bestemte tilfælde ret til at modtage dine personoplysninger, og få disse overført til anden dataansvarlig end os.
• Ret til indsigelse – du har ret til at gøre indsigelse imod behandlingen af dine personoplysninger.
• Ret til ikke at være genstand for en automatisk afgørelse – du har ret til ikke at være genstand for en automatisk afgørelse, eksempelvis profilering.

Oplysninger om klage til Datatilsynet

Du har ret til at indgive en klage til Datatilsynet, hvis du er utilfreds med den måde Herning Kommune behandler dine personoplysninger på. Det anbefales dog, at du først retter henvendelse til Herning Kommune, inden en klage sendes til Datatilsynet.

The municipality of Herning process the submitted personal data for the following reasons:

The period for which your personal data will be stored

The municipality of Herning stores and deletes the submitted data according to current legislation on final rejection applying to the case your inquiry regards.

Your rights

The general data protection regulation sets out a number of rights which is yours, when the municipality of Herning processes data regarding you. If you want to exercise your rights, you must contact the municipality of Herning.

• Right to be informed – you have a right to be informed, without unnecessary delay, about us collecting and processing your personal data (no later than a month after the collection).
• Right to access to information – you have a right to be informed about the personal data we process concerning you and in addition some further information.
• Right to rectification – you have a right to have inaccurate/wrong personal data rectified or completed.
• Right to erasure (to be forgotten) – you have a right to have personal data erased if we are not obliged by other legislation to keep your data.
• Right to restriction of processing – you have a right to have our processing of your data restricted, if certain criteria applies.
• Right to data portability – you have in certain circumstances the right to receive your personal data and have them transmitted to another controller.
• Right to object – you have a right to object to the processing of your personal data.
• Right not to be subject to a decision based solely on automated processing – you have a right not to be subject to a decision based solely on automated processing, for excample profiling.

Information regarding complaint to supervising authority/ Datatilsynet

You have a right to lodge a complaint to Datatilsynet, if you are not satisfied with the way the municipality of Herning processes your personal data. However, we recommend that you contact the municipality of Herning before lodging a complaint to Datatilsynet.
